By accessing or using Constellation and related services (collectively, the "Service") provided by ShiftinBits Inc ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
These Terms apply to all users of the Service, including individuals, organizations, and any authorized users within an organization.
Description of Service
Constellation is a code intelligence platform that extracts structural metadata from codebases to help AI development tools understand and navigate code. The Service processes abstract syntax information, symbol names, file paths, and relationships—never raw source code.
We may modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice when practicable.
Account Registration
To use certain features of the Service, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach
You must be at least 18 years old or the age of majority in your jurisdiction to create an account.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:
- Use the Service in any way that violates applicable laws or regulations

"Constellation" and related logos are trademarks of ShiftinBits Inc. You may not use our trademarks without prior written permission.
User Content and Data
You retain all ownership rights to your code and data. We do not claim ownership of any content you submit to the Service.
By using the Service, you grant us a limited license to process, store, and analyze the metadata extracted from your code solely to provide and improve the Service. This license terminates when you delete your content or close your account.
You represent that you have all necessary rights to submit content to the Service and that your use does not violate any third-party rights or agreements.
Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in the Privacy Policy.
Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice when possible)
- Emergency repairs or security updates
- Factors beyond our reasonable control
We are not liable for any loss or damage resulting from Service unavailability.

We do not warrant that the Service will be error-free, secure, or meet your specific requirements. You use the Service at your own risk.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHIFTINBITS INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Termination
You may terminate your account at any time by contacting us or using the account settings. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason with reasonable notice.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.
Changes to Terms

Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Delaware.
